Terms of Service

These terms are the agreement between you and Serna Media Inc. ("Serna Media Inc.", "we", "us"), the company that operates ClickPlays. By creating an account or using ClickPlays, you agree to them. If you don't agree, please don't use the service.
Your account
- You must give accurate information and keep your password safe.
- You're responsible for what happens on your account.
- You must be old enough to form a binding agreement (at least 13, and the age of majority where you live if you're paying).
Your content stays yours
The plays, playbooks, and notes you create are yours. We don't claim ownership of them.
To run the service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, display, and share your content, but only as needed to operate and improve ClickPlays for you (for example, saving a play, creating its thumbnail, or showing a play you chose to share). "Non-exclusive" means you keep all of your rights and can use your content any other way you like. This license ends when you delete the content or close your account, except for copies kept briefly in routine backups, and any copies others already saved or that you chose to make public.
Sharing & public content
- You decide what to share. Anything you share or make public can be seen by others.
- Only share content you have the right to share.
- You can make content private again at any time, though copies others already saved may remain with them.
Important about public content: once you make a play or profile public, or share a link, you accept that it may be viewed, downloaded, copied, saved, cached, or indexed by search engines and other people or automated tools (bots/scrapers), anywhere in the world. We can't control what others do with content after it becomes public, and we are not responsible for it. If you later make something private or delete it, copies others already saved, and pages already indexed or cached by search engines, may continue to exist outside of our control.
Fair use, what's not allowed
Please don't:
- Break the law, or post content that's hateful, harassing, or infringes someone's rights.
- Try to hack, overload, scrape, or reverse-engineer the service.
- Resell or copy the service as your own.
- Upload anything harmful, like malware.
We may suspend or remove accounts that break these rules.
Free and PRO plans
- Free accounts include a set number of playbooks and plays plus the core tools.
- PRO is a paid subscription (monthly or yearly) that unlocks unlimited playbooks and plays and other features.
- Payments are handled by our payment partners. Subscriptions renew automatically until you cancel.
- You can cancel anytime; you'll keep PRO access until the end of the period you already paid for.
- Except where required by law, payments are non-refundable. Prices and plan limits may change, and we'll give notice of meaningful changes.
Canceling & deleting your account
You can stop using ClickPlays at any time and request deletion of your account and data by emailing [email protected]. We may also suspend or close accounts that violate these terms. See our Privacy Policy for how deletion works.
You cover us (indemnification)
You agree to defend, indemnify, and hold harmless ClickPlays and its team from any claims, demands, damages, losses, liabilities, and costs (including reasonable attorneys' fees) that arise from or relate to: (a) the content you create, upload, share, or make public; (b) your use of the service; (c) your violation of these terms; or (d) your violation of any law or the rights of another person. In plain terms: if someone brings a claim against us because of something you did or posted, that's on you, not us.
The service is provided "as is"
We work hard to keep ClickPlays running well, but we can't promise it will always be available, error-free, or fit every purpose. To the fullest extent allowed by law, ClickPlays is provided "as is" without warranties, and we aren't liable for indirect or incidental damages. Keep your own copies of anything important to you.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute relating to ClickPlays or these terms will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
Changes to these terms
We may update these terms from time to time. We'll update the "last updated" date above, and continuing to use ClickPlays after a change means you accept the new terms.
